Conditions of participation
to our Startup Port Events

The Startup Port (hereinafter referred to as the ‘Organiser’) – represented by the Hamburg University of Technology, Am Schwarzenberg-Campus 1, 21073 Hamburg – is the organiser of the Startup Port Community Day 2022 (hereinafter referred to as ‘SPCD22’).
The aim of the event is to network players from the knowledge-based ecosystem of the Hamburg metropolitan region.
The SPCD22 will take place on 7 July 2022 from 16:30 to 21:30 in the Forum Finkenau of HAW Hamburg, Finkenau 35, 22081 Hamburg.
The organiser is entitled to change the schedule or time for good cause.

The organiser reserves the right to change the conditions of participation at any time.
By registering for the event, the participant confirms that he/she has carefully read and understood the following terms and conditions of participation and expressly agrees to their content, and that he/she complies with/grants/transfers all rights and obligations stated herein.
2. registration
Registration takes place via an online form on the event page.
Participation in the SPCD22 is only possible from the age of 18: Participation by under-18s is only possible together with a parent.
When registering, all information requested on the registration form must be provided to the SPCD22 organisers completely and truthfully.
The SPCD22 has an upper capacity limit for participants. The organiser therefore reserves the right to close the application option at any time. The organiser also reserves the right to fill or not fill unused participant places.
The registration only becomes effective once the organiser has confirmed the registration by e-mail. The participant will receive the access data required for participation in a further e-mail. Registration is binding and cannot be passed on to third parties.
Please note that the individual programme items are only available in real time on the scheduled date and cannot be called up at a later date.
3. processing of personal data of the participant
The Organiser collects and processes data, including personal data in connection with the overall execution of the SPCD22. To the extent that the Organiser is considered the data controller of such data under applicable laws, the SPCD22 organisers will inform the data subjects of the processing in the Organiser’s privacy policy and will process such personal data in accordance with the Organiser’s applicable privacy policy. The organiser has the right to generate anonymous user data and statistical data from participant data. The organiser reserves all rights to such anonymised data.
4. photography and filming by the organiser
As part of the event, the organiser itself will make image, sound and/or film recordings in which participants may also be depicted. By registering for the event, the participant consents to the free use of the photographs, audio and film recordings made by the organiser and their subsequent exploitation in all media, in particular also in media distribution via the Internet by the organiser and/or third parties. The right of use and utilisation is unrestricted in terms of time and territory. It also includes distribution in all languages.
The participant acknowledges that information on the Internet is accessible worldwide, can be found by search engines and linked to other information. This may mean that personal data (e.g. images) can only be removed with considerable effort, or in individual cases practically no longer. Information available on the Internet can be copied and redistributed by third parties. There is therefore a risk that information published on the Internet may remain available even after it has been deleted from the original place of publication. Insofar as publications are made in social media, the participant is aware that the organiser has no influence on the number of acts of dissemination there.
The above declaration of consent can be revoked at any time with effect for the future. The revocation has the effect that published image material is removed from the respective website and no further photos are posted. When posting on certain social media, it cannot be ruled out that the photos cannot be completely deleted.
The participant acknowledges that it may take up to three working days after receipt of the revocation for the images to be deleted from the organiser’s website and those of its commissioned third parties. In the case of printed products, the revocation means that the organiser will no longer publish the respective image material in new editions of the products already printed.
5. photo and film recordings by the participants
Audio or video recording of the SPCD22 by the participants is not permitted without the organiser’s permission.
6. rules of conduct and exclusion from participation
A participant is not authorised to do any of the following:
- register on behalf of another participant;
- to use the event for the distribution of unauthorised advertising or competitions;
- use the content of the event website or third-party services used at the event in violation of the intellectual property rights, trade secrets or privacy of third parties
The SPCD22 is designed to ensure a safe and pleasant environment and a nuisance-free experience for all, regardless of:
- Gender identity and expression
- Age
- sexual orientation
- Disability
- Physical appearance
- Ethnicity
- Nationality
- Religion
- political views
- Lack of professional or methodological experience
We do not tolerate harassment of participants in any form. Sexualised language and images are not appropriate anywhere at SPCD22.
Participants who violate these rules may be sanctioned or excluded from the SPCD22 at the discretion of the organiser.
The organiser, its employees and their legal representatives and, if applicable, their vicarious agents exercise domiciliary rights throughout the event and are authorised to issue instructions to the participant. Furthermore, the organiser reserves the right to exclude the participant concerned from further participation in the event in the event of an actual or imminent violation of these conditions of participation.
The organiser reserves the right to suspend, cancel or terminate the event in whole or in part if this is necessary and required to avert an immediate danger to the legal interests of a third party.
7. right of use
The speakers’ working documents are subject to copyright protection and other statutory property rights. The working documents are intended exclusively for the personal use of the participant. Any other use, in particular any forwarding, reproduction, making available to the public or other distribution, is not permitted without the prior written consent of Startup Port or the respective author(s). The provisions of German copyright law apply.
Irrespective of the question of whether a copyright or other property right exists in a specific working document, by registering, each participant contractually undertakes to use the working documents only for his/her personal use and to refrain from further use – as described above in paragraph 6.1.
Insofar as a participant makes protectable works within the meaning of copyright law accessible to the other participants involved in the SPCD22, the participant grants the other participants a simple transferable right of use free of charge with regard to all acts of exploitation necessary for the realisation of the event. The right of use is limited to the duration of the SPCD22.
The participant shall ensure that the granting of rights and the above waiver do not conflict with the rights of third parties. At the request of the organiser, the participant is obliged to prove how he/she has ensured this. The participant warrants that he/she will only contribute his/her own ideas and rights to the SPCD22. The participant is obliged to disclose the use of third-party rights in advance.
The participants acknowledge that the organiser or others may have developed or will develop similar or identical entries and that they waive any claims resulting from these similarities.
8. liability
The SPCD22 is prepared by the Startup Port to the best of its knowledge and belief. Liability and guarantee for the correctness, topicality, completeness and quality of the content and the programme are excluded. The organiser is not responsible and assumes no liability for the content of the participants and does not support the opinions contained therein.
The organiser therefore accepts no liability for damages that are not due to gross negligence or intent. Liability for injury to life, limb and health remains unaffected by this.
The organiser is entitled to make changes to the event at any time, to cancel the event or to cancel it in advance. In this case, the participant shall have no claim for damages against the organiser.
The content on the event website including, but not limited to, text, graphics, images, links and other materials is for informational purposes only. The Organiser does not recommend or endorse any specific software or other information mentioned on the CT-X websites. Reliance on any information provided on the Event Websites is solely at your own risk.
9. final provisions
This agreement only applies to the SPCD22 and all associated services.
Should any provision of this Agreement be declared invalid, the remainder of this Agreement shall remain in full force and effect.
These conditions do not create an agency, partnership or employment.
German law applies to these conditions of participation and the resulting legal relationship. The exclusive place of jurisdiction for all legal disputes arising from this is Hamburg, insofar as this does not conflict with mandatory law.
Should individual provisions of these conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
10. cancellation policy for consumers (for electronic registration)
The following right of cancellation only applies to consumers within the meaning of Section 13 BGB and therefore does not apply to contracts concluded by entrepreneurs within the meaning of Section 14 BGB in the context of their commercial or self-employed professional activity with the Startup Port network partners.

You have the right to cancel this contract within fourteen days without giving any reason. The right of cancellation is 14 days from the conclusion of the contract.
To exercise the right to cancel, you must inform us, Startup Port, Sebastian Bartosch, Hamburg University of Technology, Harburger Schloßstraße 6-12, 21079 Hamburg, sebastian.bartosch@tuhh.de, of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You can use the attached sample cancellation form, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.
Consequences of cancellation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.
